These Terms of Service ("Terms") form a binding agreement between you and College Thread LLC dba Athletes Thread ("Athletes Thread," "we," "us"), located at 1216 Broadway Street, Suite 415, New York, NY 10001. By accessing or using our websites at athletesthread.com, athletes.athletesthread.com, or any athlete page hosted on a custom domain we operate (collectively, the "Service"), or by purchasing products from us, you agree to these Terms and to our Privacy Policy.
If you do not agree to these Terms, do not use the Service.
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account or make a purchase. By using the Service you represent that you meet these requirements and have the authority to enter into these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at help@athletesthread.com if you suspect unauthorized use.
You may use the Service for lawful, personal, non-commercial purposes. You agree not to:
Prices for products are listed in U.S. dollars and are subject to change without notice. All sales are processed by our payment processor; we do not store full payment card information. We may decline or cancel any order at our discretion, including for suspected fraud, pricing errors, or stock unavailability, and will refund any amounts charged in such cases.
Shipping options, costs, and delivery estimates are presented at checkout. Risk of loss passes to you upon our delivery to the carrier.
Promo codes (including discount codes shared via email marketing) are subject to the conditions stated at the time of issuance, may be limited per customer, and may be revoked or changed at our discretion.
Refer to our Refund Policy for current terms. In the absence of a separate Refund Policy, returns are accepted within 30 days of delivery for unworn items in original condition. Custom or personalized items are non-returnable except for defects.
The Service and its content (including software, text, graphics, logos, the Athletes Thread mark, and athlete page templates) are the property of College Thread LLC, our licensors, or featured athletes, and are protected by U.S. and international intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for the purposes permitted by these Terms. No other rights are granted.
Athlete name, image, and likeness are used under agreements with the relevant athletes or their authorized representatives. Use of athlete name, image, or likeness without the athlete's permission is prohibited.
If you submit content to the Service (including form submissions, reviews, or messages to athletes), you grant Athletes Thread a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, and display that content in connection with operating and promoting the Service. You represent that you have the rights to grant this license and that your content does not violate any law or third-party rights.
We may remove user content at our discretion without notice, including content we believe violates these Terms or is otherwise objectionable.
The Service may contain links to third-party websites and may integrate with third-party services (e.g., payment processors, analytics providers, athlete custom domains). We are not responsible for the content, privacy practices, or terms of those third parties. Your use of third-party services is governed by their own terms.
The Service and all products are provided on an "as is" and "as available" basis without warranties of any kind, express or implied. To the fullest extent permitted by law, Athletes Thread disclaims all warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or trade usage.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components. We do not warrant the accuracy or completeness of athlete statistics, biographical content, or other information presented on athlete pages.
To the fullest extent permitted by law, in no event will Athletes Thread, its officers, directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Service or these Terms, even if advised of the possibility of such damages.
Our total aggregate liability arising from or related to these Terms or the Service will not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) one hundred dollars ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless Athletes Thread and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from (a) your use of or access to the Service, (b) your violation of these Terms, (c) your violation of any third-party right, including intellectual property or privacy rights, or (d) any content you submit.
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.
Before filing any claim, you agree to try to resolve the dispute informally by contacting us at help@athletesthread.com. We will try to resolve the dispute by negotiating in good faith for at least 60 days from the date you notify us.
If the dispute is not resolved informally, you and Athletes Thread agree to resolve any disputes through binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, in New York, New York, except that either party may bring an individual claim in small-claims court if eligible. Judgment on the award may be entered in any court of competent jurisdiction.
You and Athletes Thread agree to bring claims against the other only in your or its individual capacity, not as a plaintiff or class member in any class, consolidated, or representative proceeding. The arbitrator may not consolidate claims of more than one person.
You may opt out of this arbitration agreement by emailing help@athletesthread.com with the subject "Arbitration Opt-Out" within 30 days of first agreeing to these Terms. Opting out will not affect any other terms.
These Terms are governed by the laws of the State of New York, without regard to conflicts-of-law principles. To the extent any claim is not subject to arbitration, the state and federal courts located in New York County, New York will have exclusive jurisdiction, and you consent to personal jurisdiction in those courts.
We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. Material changes will be notified via email to registered users and through a notice on our websites at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful. Sections that by their nature should survive termination (including 7-13 and 17) will survive.
